Former Native Land Trust Board (NLTB) Director Keni Dakuidreketi and former NLTB Board member Kalivati Bakani, convicted in 2014 for ‘Fraudulent Conversion’ and ‘Abuse of Office’ respectively, have been granted leave to appeal against their sentencing and conviction.

The duo appeared before Justice Daniel Gounder in the High Court in Suva this morning.

Dakuitdreketi’s application to the court for an appeal on his Sentencing and Conviction was granted by Justice Gounder. However, an appeal for bail was declined.

Bakani’s application on an appeal for his sentencing and conviction to the High Court, was also granted by Justice Gounder this morning.

Background:

On the first occasion, between 31 March 2004 and 21 September 2004, Bakani and Dakuidreketi, while employed by NLTB and executives of Vanua Development Corporation Limited, facilitated a loan of $2,000,000 to be made by the Vanua Development Corporation Limited (VDCL) to PacificConnex Limited.

Between 16 November 2004 and 29 November 2004, the duo are said to have facilitated an additional loan of $900,000 to be made by VDCL to PacificConnex Limited.

Between 28 February 2005 and 28 April 2005, the duo, again facilitated a government grant of $1,000,000 disbursed to Vanua Development Corporation Limited through NLTB to be used as security for a loan provided to PacificConnex Limited by Dominion Finance Company Ltd.

Between 27 April 2005 and 3 July 2007, again facilitated a grant of $1,000,00 disbursed to Vanua Development Corporation Limited through the NLTB to be used as security for overdraft and loan facilities provided to PacificConnex Limited, later renamed to PacificConnex Investment Limited, by the ANZ Bank Group Limited.

Between 23 September 2005 and 29 September 2005, facilitated a loan of $1,000,000 to be made by the VDCL to PacificConnex Limited, later renamed to PacificConnex Investment Limited.
