The man who is a school teacher appeared before Judge Justice Sunil Sharma at the Suva High Court this morning.

Legal Aid Commission Lawyer Mohammed Yunis told the court in his submission, not to impose a non-parole period for his client.

Yunis also said that if given, the court should also give reasons.

State Prosecution objected to the submissions and said that the purpose of sentencing is to denounce the act of rape in society.

Judge Justice Sharma adjourned the matter to tomorrow the 23rd of June for sentencing.

The accused has been further remanded.

A secondary school teacher charged with “Rape” of a 15-year-old girl in 2015 was found guilty in the Suva High Court this morning.

The 32-year-old man was charged with one count of “Rape” and one count of “Sexual Assault”.

Judge Justice Sunil Sharma said three assessors found the accused guilty to both charges and that he accepted the Prosecution’s evidence as credible and true in regards to the case.

SHARMA: “As members of the community, assessors are to help the Judge make judgements in court.”

Justice Sharma told the court that the complainant was raped in the bathroom of her home in Vatuwaqa on 4th of December 2015. He also added that the inconsistency of the evidence produced by the complainant was natural.

SHARMA: “It is natural for a 15-year-old to react that way. The complainant had informed her grandmother after the incident and was taken to the Police station. I am satisfied with the evidence produced by Prosecution and find you guilty of “Rape” on the December 2015. I also find you guilty of one count of “Sexual Assault” on the same day.”

Justice Sharma adjourned the case for sentencing tomorrow.
